Mokra 4, 34-340 Jele\u015bnia, NIP <br \/>6292343022, REGON 388071019, e-mail address: zklimczakowachatki@gmail.com,<br \/>telephone number: +48513109392.<br \/>In all matters related to the sale of Goods via<br \/>the Online Store, the Customer may contact the Seller by post (at the address: Katarzyna<br \/>Wadas-Klimczak, ul. Mokra 4, 34-340 Jele\u015bnia or by e-mail (at the address: <br \/>zklimczakowachatki@gmail.com).<\/p>\n<p>\u00a7 1 Definitions<\/p>\n<p>1. Regulations &#8211; these regulations.<br \/>2. Customer &#8211; a natural person,<br \/>legal person or organizational unit without legal personality, but with legal capacity,<br \/>who places an Order in the Online Store on the terms set out in these regulations.<br \/>3. Consumer &#8211; a customer who is a natural person using the Online Store<br \/>for purposes not directly related to its business or professional activity.<br \/>4. Service Provider or Seller &#8211; an entity selling Goods via the Online Store<br \/>on the terms set out in the Regulations.<br \/>5. Subject of the transaction &#8211; Goods listed and described on the website of the Online Store.<br \/>6. Goods &#8211; a movable item presented in the Online Store to which the Sales Agreement applies.<br \/>7. Sales Agreement &#8211; a contract for the sale of Goods within the meaning of the Civil Code,<br \/>concluded between the Seller and the Customer via the Online Store.<br \/>8. Online Store &#8211; an online service available at zklimczakowachatki.com,<br \/>through which the Customer can place an Order.<br \/>9. Order &#8211; Customer&#8217;s declaration of will clearly specifying the type and quantity of Goods,<br \/>aiming directly at concluding a Sales Agreement.<br \/>10. Regulation &#8211; Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27<br \/>April 2016 on the protection of natural persons with regard to the processing of personal data and <br \/>on the free movement of such data, and repealing Directive 95\/46\/EC.<\/p>\n<p>\u00a7 2 General rules<br \/>1. The Regulations define the rules for using the Online Store.<br \/>2. The condition for placing an Order in the Online Store by the Customer is to read<br \/>the Regulations and accept its provisions during the execution of the Order.<br \/>3. The Online Store conducts retail sale of hand-painted items. <br \/>Sales are conducted via the Internet with shipping within the European Union.<br \/>4. All Goods offered in the Online Store are brand new, free from physical and<br \/>legal defects and have been legally introduced to the Polish market.<br \/>5. The Customer is obliged not to provide content prohibited by law, including content<br \/>promoting violence, defamatory or violating personal rights and other rights of third parties.<br \/>Technical requirements enabling the use of the Online Store include an Internet connection with<br \/>a bandwidth of at least 512kb\/s and computer hardware with<br \/>the Windows\/MacOS\/Linux operating system and a web browser in the latest stable version (we recommend Google .<br \/>Chrome, Safari, Opera, Mozilla Firefox) with JavaScript enabled or other<br \/>hardware electronic with the Android or iOS operating system with a web browser in the latest<br \/>stable version (we recommend Google Chrome, Safari, Opera, Mozilla Firefox) with<br \/>JavaScript enabled<\/p>\n<p>\u00a7 3 Placing orders<\/p>\n<p>1 All prices given in the Online Store are gross prices expressed in Polish zloty.<br \/>Prices shown do not include shipping costs.<br \/>2. Orders are accepted via the Online Store or by e-mail.<br \/>Orders can be placed around the clock, all year round.<br \/>3. The order is placed successfully if the Customer has correctly completed the Order form and<br \/>correctly provided his contact details, including the exact address to which the Goods are to be sent, as well as<br \/>the telephone number and e-mail address.<br \/>4. In the event that the data provided is incomplete, the Seller will contact the Customer. If contact with <br \/>the Customer is not possible, the Seller has the right to cancel the Order.<br \/>5. When placing an Order, the Customer must agree to the placement of personal data in<br \/>the Online Store&#8217;s database for processing in connection with the execution of the Order. The customer <br \/>has the right to inspect the personal data provided, to correct them and to request their removal<br \/>at any time<br \/>The Customer may use the option of saving his personal data by the Online Store<br \/>system in order to facilitate the process of placing another Order. For this purpose, the Customer should provide the login and <\/p>\n<p>password necessary to access his account. The Customer&#8217;s login is the e- <br \/>mail address provided by him. The password is a string of characters set by the Customer. The Seller does not have access to  <\/p>\n<p>the Customer&#8217;s password. The customer is obliged to protect the password against unauthorized access by third parties.<br \/>7. After placing the order, the Customer will receive an automatic response to the e-mail address<br \/>provided confirming receipt of the Order by the Online Store.<br \/>8. The time of commencement of the Order execution coincides with the moment of receipt of the payment to<br \/>the bank account specified in the Order confirmation (in the case of payment by bank transfer) or the moment<br \/>of paying for the Order (in the case of PayU payment) o<br \/>r the moment of placing the Order (in the case of choosing the &#8220;cash on delivery&#8221; option). The order completion time is 14 days from <br \/>the start of the order.<\/p>\n<p>\u00a7 4 Cost and delivery time<\/p>\n<p>1. Orders are processed within 1-3 business days. To this period should be added the period <br \/>of order fulfillment depending on the ordered product, if it is not available immediately.<br \/>2. The Seller reserves the right to periods of extended order fulfillment time<br \/>for reasons beyond the Seller&#8217;s control, about which the Seller will inform on an ongoing basis<br \/>on the home page of the Online Store (zklimczakowachatki.com). The occurrence of periods <br \/>of extended order fulfillment time does not require an amendment to the Regulations in \u00a7 4 sec. 1 of the Regulations. <br \/>3. The term of the Order and its delivery indicated in the Online Store is counted<br \/>in working days and starts in accordance with \u00a7 3 para. 9 of the Regulations. <br \/>4. The goods are sent to the address indicated in the Order form via Poczta<br \/>Polska. The Online Store will immediately inform the Customer about an incorrectly completed <br \/>Order form that prevents or may delay the shipment.<br \/>5. The customer is charged with the delivery costs specified in the delivery price list. The customer may previously <br \/>familiarize himself with the price list available in the Delivery and payment tab.<\/p>\n<p>\u00a7 5 Payment<\/p>\n<p>1. For each Good, a payment confirmation is issued by the online store.<br \/>2. Payment for the Order can be made via the electronic payment system (PayU)<br \/>or by transfer to the bank account of the Online Store.<\/p>\n<p>\u00a7 6 Withdrawal from the Sales Agreement<\/p>\n<p>1. The Customer who is a Consumer may withdraw from the Sales Agreement within 14 days without giving<br \/>any reason.<br \/>2. The deadline for withdrawing from the Sales Agreement starts from the moment<br \/>the Customer takes possession of the Goods, which means, among others, delivery of the shipment to the address indicated by  <br \/>the Customer. The Customer may withdraw from the Sales Agreement by submitting a statement of withdrawal to the Service Provider. <br \/>The statement can be submitted on the form, the model of which has been posted by the Seller in<\/p>\n<p>the Online Store, in the Returns tab. To meet the deadline, it is enough to send a statement <br \/>before its expiry.<br \/>3. In the event of withdrawal from the Sales Agreement, it is considered void.<br \/>4. If the Customer submitted a declaration of withdrawal from the Sales Agreement before the Service Provider accepted his offer,<br \/>the offer ceases to be binding.<br \/>5. The Service Provider is obliged to immediately, not later than within 14 days from the date of receipt<br \/>of the Customer&#8217;s statement on withdrawal from the Sales Agreement, return the value of the returned Goods. In <br \/>the event of withdrawal from the Sales Agreement in its entirety, the Service Provider is obliged to reimburse<br \/>the costs of delivery of the Goods (in the amount of the cost of the cheapest delivery available on the day of placing<br \/>the order). The Service Provider may withhold the reimbursement of payments received from the Customer <br \/>until receipt of the return of the Goods or delivery by the Customer of proof of sending back the Goods,<br \/>depending on which event occurs first.<br \/>6. In the event of withdrawal from the Sales Agreement in its entirety, the Service Provider is obliged to reimburse<br \/>the costs of delivery of the Goods (in the amount of the cost of the cheapest delivery available on the day of placing<br \/>the order). In the event of withdrawal from the Sales Agreement in part, the Service Provider is not<br \/>obliged to reimburse the cost of delivery of the Goods, unless failure to purchase the returned part of the Goods<br \/>would reduce the value of the delivery. In this case, the Service Provider will return the appropriate part<br \/>of the value of the cheapest delivery available on the day of placing the order.<br \/>7. The Service Provider may withhold the reimbursement of payments received from the Customer until receipt of<br \/>the return of the Goods or delivery by the Customer of proof of sending back the Goods, depending<br \/>on which event occurs first.<br \/>8. If the Customer exercising the right to withdraw from the Sales Agreement has chosen a method of delivering<br \/>the Goods other than the cheapest method of delivery offered by the Service Provider, the Service Provider is not<br \/>obliged to reimburse the Customer for the additional costs incurred by him.<br \/>9. The Customer is obliged to return the Goods to the Service Provider immediately, but not later than within 14<br \/>days from the date on which he withdrew from the Sales Agreement. To meet the deadline, it is enough to send<br \/>the Goods to the following address:Katarzyna Wadas-Klimczak, ul. Mokra 4, 34-340 Jele\u015bnia before this deadline.<br \/>10. In the event of withdrawal from the Sales Agreement, the Customer bears the costs of returning the Goods. If the <br \/>Customer fails to collect the Goods, which is presumed to be a withdrawal from the Agreement, the Customer<br \/>shall be charged with the costs of returning the Goods to the Seller.<br \/>11. The Customer is responsible for the decrease in the value of the Goods as a result of using it in a way that goes beyond what is necessary to establish the nature,<br \/>characteristics and functioning of<br \/>the Goods.<br \/>12. The Service Provider refunds the payment using the payment method used by the Customer.<\/p>\n<p>\u00a7 7 Warranty<\/p>\n<p>1. The Service Provider ensures the delivery of Goods free from physical and legal defects. The Service Provider <br \/>is liable to the Customer for physical or legal defects.<br \/>2. If the Goods have a defect, the Customer may:<br \/>A. submit a statement of price reduction or withdrawal from the Sales Agreement &#8211; unless the Service Provider,<br \/>immediately and without undue inconvenience to the Customer, replaces the defective<br \/>Goods with defect-free Goods or removes the defect. This limitation does not apply if the Goods have already been replaced <br \/>or repaired by the Service Provider or the Service Provider has not fulfilled the obligation to replace the Goods<br \/>with defect-free Goods or remove defects. The Customer may, instead of the removal of the defect proposed by the Service Provider, <br \/>demand replacement of the Good with a defect-free one, or instead of replacing the Good, demand removal<br \/>of the defect, unless bringing the item into compliance with the contract in the manner chosen by the Customer is<br \/>impossible or would require excessive costs compared to the method proposed by<br \/>the Service Provider. When assessing the excess of costs, the value of the Goods free from defects, <br \/>the type and significance of the defect found are taken into account, and the inconvenience to which the Customer would be exposed by a different method of<br \/>satisfaction is also taken into account;<br \/>B. demand replacement of defective Goods with goods free from defects or removal of the defect. The Service Provider is <br \/>obliged to replace the defective Goods with defect-free Goods or remove the defect within a reasonable time without<br \/>excessive inconvenience to the Customer. The Service Provider may refuse to satisfy the Customer&#8217;s request <br \/>if bringing the defective Goods into compliance with the Sales Agreement in the manner selected by<br \/>the Customer is impossible or would require excessive costs compared to the other possible way of bringing the defective Goods<\/p>\n<p>into compliance with the Sales Agreement. The costs of repair or replacement are borne by <br \/>the Service Provider.<br \/>3. The customer who exercises the rights under the warranty is obliged to deliver the defective item to<br \/>the address of the Service Provider. In the case of a Customer who is a Consumer, the cost of delivering the Goods is covered by <br \/>the Service Provider.<br \/>4. The Service Provider is liable under the warranty if a physical defect is found within<br \/>two years from the delivery of the Goods to the Customer. A claim for removal of a defect or replacement of the Good with a<br \/>defect-free one expires after one year, but this period cannot end before the expiry of the period<br \/>specified in the first sentence.<br \/>5. If the Customer requested the replacement of the Goods<br \/>with a defect-free one or removal of the defect, the deadline to withdraw from the Sales Agreement or submit a price reduction statement begins with<br \/>the ineffective expiry of the deadline for replacing the Goods or removing the defect.<br \/>\u00a7 8 Complaints<\/p>\n<p>1. Any complaints related to the Goods or the implementation of the Sales Agreement<br \/>may be submitted by the Customer in writing to the following address: Katarzyna Wadas-Klimczak, ul. Mokra 4, 34-340 Jele\u015bnia, or<br \/>by e-mail to: zklimczakowachatki@gmail.com.<br \/>2. The Service Provider will respond to the complaint within 14 days of its delivery.<br \/>\u00a7 9 Privacy policy and personal data protection<br \/>1. The administrator of the databases of personal data provided by the Customer of the Online Store<br \/>in connection with the Orders placed is the Service Provider.<br \/>2. Issues related to the protection of personal data are regulated in<br \/>the Service Provider&#8217;s Privacy Policy.<br \/>3. The Customer&#8217;s personal data may be made available by the Online Store to recipients of personal data<br \/>other than the Service Provider.<br \/>4. If the transfer of the Customer&#8217;s personal data takes place:<br \/>A. in order to conclude a Sales Agreement with the Online Store, providing personal data by the Customer<br \/>is a condition for concluding a Sales Agreement. Providing personal data in this situation is<br \/>voluntary, but the consequence of not providing this data will be the inability to conclude a<br \/>Sales Agreement with the Online Store;<br \/>B. to the Bank in connection with the handling and settlement of payments made by the Customer to<br \/>the Online Store via the Internet using payment instruments, providing data is<br \/>required in order to make the payment and provide confirmation of its execution by the Bank to<br \/>the Online Store;<br \/>C. to the Bank in order for the Bank to verify the proper performance of contracts concluded with the Online<br \/>Store, in particular to ensure the protection of payers&#8217; interests in connection with their complaints,<br \/>providing these data is required to enable the performance of<br \/>the contract concluded between the Online Store and the Bank;<br \/>5. In matters relating to the protection of personal data and not covered by the Regulations,<br \/>the provisions of the Privacy Policy and the Civil Code and the relevant provisions<br \/>of applicable Polish law, as well as European Union law, in particular the<br \/>Regulation, shall apply.<\/p>\n<p>\u00a7 10 Change of regulations<\/p>\n<p>1. The Regulations may change. We recommend reading the Regulations <br \/>each time before placing an Order.<br \/>2. Orders placed by Customers before the entry into force of the amendments to the Regulations<br \/>will be implemented in accordance with the existing provisions of the Regulations<\/p>\n<p>\u00a7 11 Final provisions<\/p>\n<p>1. The content of the Regulations may be recorded by printing or saving on a selected medium.<br \/>2. In the event of a dispute regarding the Sales Agreement, the Customer and the Service Provider<br \/>undertake to strive for an amicable resolution of the dispute. The law applicable <br \/>to the resolution of any disputes arising from the Regulations is Polish law.<br \/>3. The customer may use extrajudicial means of dealing with complaints and pursuing claims,<br \/>including mediation. Lists of permanent mediators and <br \/>existing mediation centers are provided and made available by the presidents of the relevant District Courts.<br \/>4. Any disputes related to the Sales Agreement may also be resolved by the Customer<br \/>via the ODR online platform.<br \/>5.
